Bench Warrants in Eddy County
New Mexico's public paperwork says "bench warrant" and "Failure to Appear in Court Warrant" for the same thing. In Eddy County, one can follow a missed court date, an ignored subpoena, a broken release condition, unpaid fines, a probation violation, a contempt finding, or almost any court order. The judge signs it. From there it can direct arrest and a return to court, though how a person gets released or seen by a judge depends entirely on the case. The clerk of the court that handled the matter keeps the file and decides the next step. So use Case Lookup to find that court, then call its clerk rather than assuming the Sheriff holds every bench warrant in Eddy County.
The Nine Trigger Choices on Form 9-212C
Form 9-212C, the New Mexico Magistrate and Municipal bench-warrant model, shows what a local record can contain. The judge marks one of nine reasons: failure to appear as ordered, failure to appear on a subpoena, failure under release conditions, release review or revocation, contempt, failure to pay fines or costs, probation noncompliance, first-offender-program nonappearance, or other facts. The form also carries court and case fields, defendant identifiers, bond or payment choices, execution jurisdiction, a judge signature, system entry, and return. It is a blank official template, so it reveals the shape of an Eddy County warrant, not any person's record. The official criminal-form index publishes the form itself.

Use the court’s current form and instructions when asking about a specific file.
How an Eddy County Bench Warrant Is Issued
The judge acts within the court that has authority over the case. That court records the reason, signs or approves the warrant, and pushes the information into the law-enforcement workflow. A Magistrate or Municipal bench warrant in Eddy County may ride on Form 9-212C, while a District Court bench warrant uses a district form with its own bond and extradition fields. Nothing funnels all of this into one county database. District, Magistrate, and Municipal clerks keep separate case universes. So when an appearance was missed, take the citation, docket, or notice and call the court printed on it. That court, not a county-wide list, controls the Eddy County bench warrant you are chasing.
Bench Warrants in Carlsbad, Artesia, Hope, and Loving
Carlsbad and Artesia Magistrate Courts issue bench warrants in state-court misdemeanor, DWI, traffic, and preliminary-hearing cases. Carlsbad Municipal Court, plus the municipal courts in Artesia, Hope, and Loving, handle their own ordinance, traffic, petty-misdemeanor, and municipal-DWI warrants. A municipal warrant belongs to the city or village clerk, never the Eddy County Clerk.

Bench Warrant Versus Arrest Warrant
A bench warrant grows out of a case already in court: a missed appearance, unpaid amount, broken release term, probation issue, or contempt event. An arrest warrant is different. It rests on probable cause for an offense and commands an officer to arrest and bring the person before a court. Either can land someone in custody in Eddy County. But the two records answer different questions, so knowing which one exists tells you who to call.
| Question | Bench warrant | Arrest warrant |
|---|---|---|
| Why issued? | Missed appearance or noncompliance. | Probable cause for an offense. |
| Local model | Form 9-212C or District Form 9-212. | Form 9-210, with Form 9-209 affidavit when needed. |
| Next call | Court handling the existing case. | Court handling the charge and probable-cause process. |
Why “Capias” May Not Be the New Mexico Label
Some readers hunt for "capias" or "capias pro fine." The official Eddy County and New Mexico sources do not use those labels. Court forms and the AOC workflow say bench warrant, Failure to Appear in Court Warrant, surrender, served, canceled, and returned unserved. When you call a clerk, read the wording straight off the citation or docket and ask whether the court treats it as a bench or FTA warrant. A synonym search might bring you to a page like this one. It cannot replace the term the issuing court itself uses.
Plain language: Ask the court to confirm the exact warrant type and the action it will accept.
How to Resolve an Eddy County Bench Warrant
Start with a phone call to the issuing court. Ask whether it accepts a voluntary appearance, wants a motion to recall or quash, needs a new arraignment, allows payment or a plan, or requires bond. Ask what identification and documents to bring. A lawyer can advise on surrender, the underlying charge, and whether an appearance should be set. The Eddy County courts differ in practice. Carlsbad Municipal Court lets a clerk grant one extension, and anything further goes to a judge. Artesia tells people with a payment problem or an issued bench warrant to call. Hope and Loving publish phone routes because neither offers an online warrant lookup.
Before traveling: Confirm the court’s appearance route and keep written proof of the disposition after the matter is addressed.
Online Payment May Not Clear a Bench Warrant
Paying online may not end the matter. New Mexico's public-access payment notice says electronic payment resolves financial obligations only. A missed appearance, required proof, probation condition, release term, or bench warrant can still need separate court action. Artesia's own guidance says to call when the citation is not found, an appearance is required, the data is wrong, or a bench warrant has issued. So ask the Eddy County court whether a fine, warrant, MVD notice, and court date are separate items. A payment receipt is not a clearance order.
Which Eddy County Court Issued It?
Use the court location to route the call. District felony matters go to the Fifth District Clerk at 575-885-4740. Carlsbad Magistrate uses 575-885-3218, and Artesia Magistrate uses 575-746-2481. Carlsbad Municipal uses 575-885-3363, Artesia Municipal uses 575-746-2122, Hope uses 575-484-3351 or 575-703-3316, and Loving uses 575-745-3511 extension 1005. The court directory lists each state-court location separately. Confirm hours before you go; posted hours do not promise a same-day judge, recall, or walk-in hearing in any Eddy County courtroom.

Route by case and court, not by the word “county” on a notice.
Safe Surrender Was an Event, Not a Permanent Counter
Eddy County residents had a rare window in 2025. New Mexico Courts ran Carlsbad Safe Surrender on August 22 and 23, 2025, aimed at outstanding Magistrate bench warrants. Anyone with such a warrant could walk in voluntarily and ask a judge about a new court date, a payment plan, or another way to get back in compliance. The deal was not a free pass: no immunity, no fee waiver, and no promise of avoiding arrest in every situation. Carlsbad Municipal Court ran its own track during the event for municipal warrants. Court Operations later counted 1,022 warrants cleared at Carlsbad, though that number measures the event, not the bench warrants still open across Eddy County today. Before counting on a future Safe Surrender covering your court, check current Courts program information rather than assuming one is scheduled.
